Meeting with MCO Properties and Swaback Partners

We are all very interested in the future of Suncrest and it sounds as if we’d be in good hands with MCO Properties and Swaback Partners. Both companies presented their proposals for the future of Suncrest, stating the following:
Jeremy Hall of MCO Properties gave us some background on the history of MCO…in business since the 60’s and evolved by the mid-70’s, paying attention to the environment and natural topography. They specialize in hillside development and were not surprised to hear of the issues surrounding Suncrest as they collaborated with Layne Long of Draper City. There’s simply too much density. They found Suncrest four years ago prior to bankruptcy and Zions taking it over. They recognized how special the land is and all it has to offer (Draper has some of the best mountain biking trails, road cycling, equestrian center), thus, their diligent studies of Suncrest and surrounding areas. MCO Properties, along with Swaback Partners, wants to make a unique plan for Draper, understanding the history of Draper and the simplicity of the natural beauty. We are about a theme/brand that echoes the concept of Draper City, embracing the natural beauty and preserving the natural fauna.
Vernon Swaback of Swaback Partners informed us of their involvement with Promontory and Glenwilde, maintaining relationships to vistas and the existing wildlife corridor. Mr. Swaback quoted Frank Lloyd Wright, “Invest wisely in beauty – it will serve you all the days of your life.” He has always believed in the truth of that quote and aims to reflect such through their work. We then heard from Jeffrey Denzak (I was not able to verify his name), but, he, too, is with Swaback Partners and finished the meeting with the following:
As a partner at Swaback, it’s always been clear that the company is very strategic to not become too big, as we are very concerned about quality and maintaining senior level involvement. I was captivated by Mr. Swaback’s work and dedication and was drawn to his firm. We have as part of our team architects, landscape architects, planners, urban/interior/graphic designers. We understand that it’s not about one big idea, it’s about doing 1,000 things really well over time, being sensitive with the land. We are a legacy developer, committed long term and interested in raising the bar. It is important to us to have re-vegetation and restoration in place to preserve the topography and to avoid slope failure and erosion.
A model for development must exist to be sustainable. We define a road, identify a lot and determine where a development envelope exists. We’re proposing an area of development with ¾ acre to 5 acre lots, limiting disturbance to the land. The majority of the land on the bigger lots would become part of an easement so as to maintain the wildlife corridor and create minimal disturbance to the land. He noted that our current design guidelines are actually fairly good; they just haven’t been adhered to. We have spent a lot of time studying the land and understand that we must have a sensitive strategy of a structure that can be built on any given lot based on its slope (0-10%, 10-20%, etc.) We think an authentic theme for the architecture of this community (agrarian/mining) in keeping with Draper’s history will preserve the quality and character of the community. Functionality and safety are also important. At the outset of a project, we develop a mission statement including core principles and are sure to maintain such throughout the project. We intend to have future development mesh with the existing community; finishing planned parks; incorporating other projects to enhance existing Village Center. We’d also be considering current issues, such as parking at the Community Center, bus stop, etc. We’ve identified that buyers want preserved open space and understand the importance of the trail system that exists. Also thinking about winter recreation; a farmstead area (stables, equestrian center).
Both companies presented maps of the community as well as pictures of various projects in the southwest with which they’ve been involved. I was not able to stay until the end, but certainly felt as if both companies had done their due diligence and would not be presenting such proposals if they weren’t close to making a purchase. Hopefully we will be receiving news of such in the very near future. Sure sounds as if it would be a win, win for Suncrest and all of us as residents. Here’s hoping…

SunCrest OA meeting recap of MCO

Dear SunCrest Homeowners,

Thank you for attending the MCO presentation last Friday, October 14. For those who were unable to attend, please see the meeting notes below.

After some opening remarks and an introduction by the Mayor, the meeting was conducted by Jeremy Hall, president of MCO Properties; Vernon Swaback, principal of Swaback Partners; and Jeff Denzak, senior land planner of Swaback Partners. We estimated over a hundred people in attendance, and based upon a show of hands, SunCrest residents accounted for about three-fourths of attendees. Mayor Smith, Councilmen Rappleye and Stenquist, city manager Layne Long and CCMC management from SunCrest and Daybreak were also in attendance.

Jeremy Hall opened with some history of the company and the company’s expertise in developing on hillsides. He described his approach to the future of SunCrest by working more sensitively with the natural topography, preserving natural vegetation and slopes as much as possible and shifting the focus to larger natural lots. He introduced their land planner, Swaback Partners, who discussed sophisticated land planning techniques and various product types all with a new consistent theme that will echo the small-town charm of Draper and the pioneering/agrarian/mining history of the area. They discussed building techniques and styles they will avoid and demonstrated examples of how to build on hillsides that is sensitive to the natural terrain.

They are re-planning the undeveloped land and reducing the overall density as compared to the original land plan. There will be more natural open space including natural areas preserved on large lots. Amenities will be largely focused on the natural environment with preserving views, maintaining hiking and biking trails and possibly including horseback riding and a second club amenity for the property east of SunCrest Drive.

Meeting Notables:

v Lower overall residential units planned for the development as compared to the original land plan.

v More large natural lots and preservation of natural areas.

v MCO will complete Falcon Park.

v Development of new neighborhoods would likely not start right away due to the economy. The project will be phased; however, the market will determine where and when MCO begins construction.

v Select areas of grading for higher-density housing will be limited to where the natural topography is suited to it.

v MCO will be working on redefining and repositioning SunCrest’s brand and starting a marketing and public relations campaign. This will be important in repositioning SunCrest for future growth and development.

v Due diligence needs to be finalized including finalizing the new land plan with Draper City. MCO has been working closely with city staff and is hopeful this will be complete in the next few months.

The meeting lasted about 3 hours and Mr. Hall, Mr. Swaback and Mr. Denzak stayed until the last resident left to answer all questions. All in all, the meeting went very well, and the reaction was very positive.

Update on Club house

The Draper City Council approved the plat amendment tonight and we are getting our long awaited clubhouse finally signed over to the OA. There was a tentative opening this weekend but is pushed off another week or so. The furniture won't be in until the 29th. There will be a soft opening in next week or so. Then you can come and check out the clubhouse, exercise room, and get your electronic passes. There will be a grand opening celebration in May. The life guards and heated pool will be open and ready Memorial weekend.

I also got a chance to sit in on a meeting tonight that had the MCO developer present its plans to Draper City for SunCrest. Very exciting stuff coming. They are still working on ideas but they showed lots in the hog hollow area from 1-5 acres. On the lot only a portion of it can be built and disturbed. The other part of lot is to be left natural and untouched. Other areas would have pocket subdivisions that have homes built around parks with rear entries. They want lots of park areas and possibly another clubhouse. I think they actually got the city excited about the new SunCrest. I can't wait for the presentation to be shown to the residents.

Update on new Developer, MCO

Notes from the OA Board Meeting on Tuesday, March 15th, submitted by Paula Roth, Eagle Crest resident:

I attended the Board of Directors meeting last night and thought you might find the comments from Jeremy Hall, President of MCO Properties, interesting.

Here it is in a nutshell:

MCO Properties has been in existence since the early 70's and has a presence in every southwest state except for Utah.
They specialize exclusively in hillside properties and have been looking at Suncrest for years (even when Terrabrook was still involved).
They are in talks with Zions Bank and Draper City and have signed a purchase contract. They now have six months of due diligence and are currently trying to understand the geo-technical/land issues so that those can be addressed first and foremost.
There is a long punch list of items that would need to be addressed by Zions, Draper City and/or MCO Properties if the sale is successful.
First things would be water, drainage mitigation and roads.
The vision of MCO Properties is to include significantly larger, multi-acre lots for custom homes to make the east portion of the development the "Deer Valley" of Draper. We foresee completion to take 15-20 years.
If MCO takes over, they would start with a clean slate and re-plan the remainder of the undeveloped property, figuring significantly less build out than originally planned.
MCO Properties is very much about working with the natural land, keeping a lot of open space and maintaining the wildlife corridor that already exists.
They are talking to Draper City and Zions about completing pocket parks in already developed areas.
They are meeting with both school districts to determine any issues that may exist.
MCO will be holding a town hall meeting sometime in April so that residents can voice their concerns and receive further information from MCO Properties...watch your e-mail for notification from the Suncrest OA.

We were told that Draper City has been cooperative thus far and seem to simply want to fix the problems that currently exist.

SunCrest Cell Tower

I have been communicating with City Manager, Layne Long and also Councilman Bill Rappleye today about the proposed Verizon Cell Tower update. In May 2009 Verizon met with residents about potential sites (see Cell Tower label on right-hand sidebar for full history) and options.

Today, the Owner's Association sent out a request at 2:00 requesting input on the cell tower for a meeting tonight that began at 6:00pm. Here is some of the correspondence:

Thanks DeLaina, yes more notice should have been given! None on the council liked the monster tree design so a water tower design is being explored.
We do seek feedback on this new idea and concept.

Bill Rappleye Russ is in charge of this project but I did not have a sense there is a rush, bring the comments to the next council meeting (public comment at the first of the mtg)or we could work to have it as an agenda item at a future mtg.

Layne sent me the pictures of the proposed styles.

The top one is the Water Tower and the bottom is the called the Stealth Monopine. The location is just south of the market/The Cove.

Looking for new Draper Youth Council members

The City of Draper and Mayor Darrell Smith are proud to announce a new and exciting opportunity for the rising 9th-11th grade students.

The new Draper City Mayor’s Youth Council will provide our youth an opportunity to increase their knowledge of civic education through practical hands-on experience. The Youth Council will be composed of twelve 9th-12th grade students who will be charged with representing youth in the City of Draper.
The Mayor’s Youth Council will:

•Involve youth in local government through participation on local boards and committees.
• Increase youth voice and communication in Draper’s future.
• Increase

volunteerism among youth and adults in civic affairs; and
• Enhance civic education through teacher/community training.
We will be distributing applications through schools this month. Applications will also be available on the city website (www.draper.ut.us) and at City Hall. All applications will be due January 31, 2011. The selection process will occur in February, with our first activity scheduled for March 2011. Please discuss this exciting opportunity with your rising 9th grader or high school student and encourage them to apply for service on the Draper City Mayor’s Youth Council.

Status of SunCrest Clubhouse

The Occupancy permit has be signed by Draper City. We are just waiting for the Planning commission and city council to approve the zoning of the land the clubhouse sits on. Hopefully, the city will get this on the agendas and approved later this month.

SunCrest Clubhouse update

SunCrest Owners Association has received many inquires concerning the opening of the Community Center. At this time, we feel it important to respond to some commonly asked questions and address a few misconceptions.

Is/was there an agreement between SunCrest Owners Association and the past Developer (SunCrest, LLC) as it pertains to the Community Center?
No. There was never a “contract” or “agreement” between SunCrest, LLC, and the Owners Association that involved the Community Center. There was a proposal that detailed items that needed to be purchased and amenities that required support before the Community Center could open. However, nothing came of this proposal due to the bankruptcy of SunCrest LLC.

I understand Salt Lake County or Draper City would like to take over the Community Center. Is this true?
Salt Lake County has never offered or shown interest in taking over the facility. Moreover, Draper City has withdrawn its interest to run or operate the facility. Therefore, Zions Bank, who assumed the assets (and responsibilities) at SunCrest following SunCrest, LLC’s bankruptcy, decided the Community Center will be conveyed to the Owners Association.

How much would fees increase if the Community Center was operated by the Owners Association?
At the September 21, 2010 Board of Trustees’ meeting, the Board approved the 2011 Master Association Budget, wherein the 2011 Assessments remain at the current rate of $98.00 per month. This budget did not, however, include any costs associated with operations of the Community Center. As it currently stands, the monthly assessment is estimated to increase $37.00 per month.

In light of the recent announcement by the Zions Bank to turnover of the Community Center to the Owners Association, CCMC and the Association’s Budget & Finance Committee are working diligently on an amended 2011 budget that includes all anticipated costs for the Community Center. The Budget & Finance Committee is comprised of SunCrest residents (Gary Bromley, Amy Baird and Doyle Judd). As soon as this process is complete and reviewed by the Budget & Finance Committee, it will be presented to the Board of Trustees for approval. All Association Members will be notified in writing of the amended budget and the revised monthly Assessment prior to any chance taking effect. There will also be a Towne Hall Meeting in January 2011 to discuss the budget and answer questions.

Why we have the SunCrest Owners Association?
Owners Associations are formal legal entities created by Developers to uphold high standards for the community and have the ability to care and maintain the following:

· Establish and collect maintenance fees needed to run neighborhood operations

· Maintain community landscaping

· Maintain recreational facilities

· Provide space for events or neighborhood functions.

· Arrange for street maintenance

· Enforce deed restrictions including, but not limited to, exterior home maintenance, commercial use of properties, control of trash and blight.

Owners Association also protect the value of their homes and neighborhoods. We do this by keeping the area looking attractive and maintained. The OA also insures builders/owners do not do anything wild, like painting their house pink, parking a truck on their front lawn, leaving dismantled vehicles in the street, or using their driveway as a garbage dump. OA’s are established to ensure that Covenants, Conditions & Restrictions (CC&R’s) are adhered to in order to maintain the quality and value of the properties involved.

There is the misconception that the Owners Association is “no longer valid” when SunCrest LLC, filed and its debts were discharged by the bankruptcy court. SunCrest LLC’s bankruptcy complicated the business of the Owners Association, but it did not affect or invalidate its purpose. SunCrest LLC, and the SunCrest Owners Association are/were separate and distinct companies. SunCrest LLC, was a for-profit development company, that recorded the Declaration of Covenants, Conditions, Easements and Restrictions for SunCrest, A Planned Community (the “CC&Rs”), against the title of each Lot and Parcel in the SunCrest Community.

The SunCrest Owners Association, Inc., on the other hand, is a non-profit company, formed for the purpose of enforcing the CC&Rs and the obligations and restrictions contained in the Association’s other governing documents, i.e. the Bylaws, Design Guidelines, Rules and Regulations, etc. These governing documents, by their own terms, “run with the land”. Therefore, in order to terminate the Owners Association before the term of the CC&Rs expire (earliest date December 2049), a vote of the Members must take place. Please see below the verbiage from the SunCrest OA CC&R’s:

Article XVIII of the CC&RS, Section 18.1 Term: Method of Termination: “The Declaration may be terminated at any time if eighty percent (80%) of the votes of the Members shall be cast in favor of termination at an election held for such purpose. Anything in the foregoing to the contrary notwithstanding, no vote to terminate (or amend as provided in Section 18.2) this Declaration shall be effective unless and until written consent to such termination or amendment has been obtained, with a period from six (6) months prior to such vote to six (6) months after such vote, from Eligible Mortgagees on fifty-one percent (51%) of the Lots and Parcels upon which there are such Eligible Mortgages.”

Is this true that our property taxes are paying for services we receive at SunCrest and the property management company is only providing limited cable and internet?

The property taxes that Members pay finance certain services that Draper City provides. This includes, but no limited to: police, fire, streets and code enforcement. However, these property taxes do not pay for many of the services that Members enjoy at SunCrest, i.e. maintenance of the Common Areas and Open Space, Swale Inspections, Christmas Lighting, Billing, Accounting, Collections, CC&R Enforcement and Special Events (Movies, Easter Egg Hunt, Trunk-or-Treat, etc.)

Furthermore, there are times that the SunCrest Owners Association enlists the help of Draper City in terms of Code Enforcement of City ordinances and animal control. When the Association suspects there is a violation of a Draper City Ordinance, the Association notifies the City of these concerns and requests code enforcement officers to investigate. However, SunCrest Owners Association cannot depend on the City to enforce its CC&Rs, Design Guidelines and Rules and Regulations, as Draper City has no authority to enforce these documents. The SunCrest Owners Association has more stringent rules on a wide variety of categories than those included in the city ordinances, e.g. incomplete landscaping, garbage cans, fences, chain link, debris, improvements, machinery, signage, trailers, campers, boats, parking, window coverings, drainage swales, lighting, poles, businesses, etc. Accordingly, the Association relies upon CCMC to notify Members of alleged violations, provide incentives to comply and exercise all available enforcement powers if Members fail to cure violations.

George Dew graduated from the University of Colorado in Boulder with a BA in biochemistry. Following graduation, he served six years as a Navy SEAL at SDV Team ONE in Coronado, California, and SEAL Team FOUR in Little Creek, Virginia. After his Navy service, he received an MBA from Georgetown University, and then went to work in corporate finance on Wall Street. Shortly thereafter, he left Wall Street to serve as an operations officer in the Central Intelligence Agency. In 1998, he joined the Ackerman Group, a corporate security company specializing in negotiating kidnap & ransom cases, resolving extortions, death threats, providing executive protection, and assisting in physical security issues. We have had several incidents in Suncrest recently where suspects have stolen valuables left in front yards or in unsecured garages. We have increased our patrols of Suncrest, but would like to remind people to secure their homes, cars, and items. I would like to also like them to remember to remove valuables from vehicles parked outside.
This would help us a ton.

SunCrest OA board meeting

Here are some unofficial meeting minutes:

-We are getting the clubhouse. Zions is working on getting the occupancy permit with the city. We should have the club house within the next couple of months.
-We are getting the club house unfurnished. There is a kitchen with refrigerators, counters, and sinks. But that is it. It isn't approved for a grill. There is a workout room that has almost all the equipment except for items likes treadmill, StairMaster, bike, etc. Also a few tables and chairs.
-The OA has money set aside that can be used to furnish the club house so we can at least use it and move the management company in there.
-There will be an HOA increase in dues to cover the club house. It may be around $35 extra a month. This will still need to be discussed.

-We also get the Pool! It was cleaned and filled so it could pass inspection, which it did. By the time we get the club house we won't be able to use it until next summer.

-The roads in Eagle Crest should be finished in about a week. They will finish it with a final coat of slurry seal. Zions is working to finish all roads but SunCrest drive to try and get them turned over to the city.

-Developer? Nope lots of interest but no offers in the works. Zions said because of the economy it may be awhile. Now the city says a developer is interested that they are working with but Zions said no has made any offers to them?

-There is no one interested in the SunCrest market at this time.

-Does anyone have information about a helicopter that landed on property on Falcon Ridge last night and took off at 7am this morning. Let the SunCrest office know.

TRSSD tax rate approval

Draper City is holding a meeting on September 21st at 8:30pm at city hall chambers to adopt a revised property tax rate for Traverse Ridge Special Services District.

The City will be holding a TRSSD meeting to adopt a revised property tax rate. This is the rate the Utah State Tax Commission has certified as the equalized tax rate for the District which means it is a weighted average of the two counties certified tax rates. The word ‘certified’ means there was no tax dollar increase, but due to some change in legislation the formula cities have used for years to calculate the tax rate was changed and became much more complicated.

The original tax rate adopted by the City and originally certified by the State was .003263.

The revised tax rate is .003171 and is the rate property owners have received on their tax notices already.

SunCrest Clubhouse?

Have you noticed some road construction in Eagle Crest? Well Zion's Bank hired Utah Homes to do the needed repairs so the city will take over the roads in Eagle Crest. Now its been noticed that they are working on the clubhouse now. The pool is all cleaned out, landscaping going in, and working in the inside. In order for the clubhouse to get its occupancy permit it needed to finish those same things. I haven't heard nor has SunCrest management if Zion's plans to open the Clubhouse. It sure would be nice, but nicer if they did it when we could actually USE the pool. Oh, and Utah homes plans on taking that ugly trailer above the market when they are finished.

Tunnel under Traverse Ridge?

New information: The tunnel and land acquisition was voted and approved by not only Salt Lake County Council, who funded the money, but Draper Councilmen, Walker, Summerhayes, and Stenquist. Ms. Davis and Mr. Colbert voted against the deal. This was all approved in July 2009. The April 2010 meeting about the tunnel was to vote to ask for grants to cover the cities tunnel expense up to $190,000. No grants have been received as of yet. As for the winter ice build up over the tunnel. I was told that their should be enough utilities and material between the tunnel and road that it wouldn't freeze over like a highway overpass would.

You may have been wondering about all that construction going down the mountain on Traverse Ridge. They are actually building a tunnel for a trail system. Remember last year Salt Lake County helped Draper purchase 141 acres for $2.75 million from South Mountain Developer, Terry Diehl. A condition in the settlement was that Mr. Diehl provide access to link the newly acquired acres called Little Valley for a trail system. Below is the Draper City council minutes from April 20, 2010. There is also a resolution 10-21 talking about the little valley tunnel. It states Draper city will pay up to $190,000 for the tunnel. (If you click on the pictures they become larger) Well sorry I didn't catch this during discussions in April so you could be notified and make your comments to the city council. I guess its the LITTLE VALLEY TUNNEL part that didn't catch my attention. I sure hope they plan on putting some kind of heat tape on the road going over the tunnel, because the wind sure does whip snow through there in the winter. I would think black ice would develop causing major problems for US who have drive down the mountain. I sure hope the deer get some use out of the tunnel instead of crossing the street :-)

Updates on SunCrest

I met with Draper City today about the TRSSD. Here is some of the information we discussed.

-Town Hall meeting in SunCrest about TRSSD. Waiting on confirmed date in August or September. Worked on an agenda so we could be able to answer all the residents concerns.
-TRSSD Committee. Checking to see if City Council is still interested in forming a committee of residents to do research on items related to TRSSD.
-Roads. I wanted to know status of city taking over Eagle Crest roads and re paving of Deer Ridge.
-Snow Plow services. Will research and discuss pros and cons of outsourcing the snow plowing this winter.

SunCrest Fire Station status: The city can't use the TRSSD funds to pay for any part of the fire station, because its not included in the orginal contract of the TRSSD. The SunCrest residents would have to put it to a vote to add the fire station to the TRSSD.

SunCrest Developers? There are currently two in state developers working with the city on purchasing SunCrest. They have presented development plans and the city is working with these developers to make it happen. So hopefully good news coming in the next few months.

Help needed from Residents: Tell me what questions you have about the TRSSD so I can have the city get answers ahead of time before the town hall meeting. I also want to know the good and bad about snow plowing this past winter. Please tell me if it was the city drivers or Zion's contracted guys. If your not sure, then tell me which road your talking about. This will help on the deciding if we should outsource snow plowing.

Covenants Committee

"The Covenants Comittee needs two new members:
The recent departure of two members creates a need for two replacements. What is the Covenant's Comittee? We are the human "face" of the SunCrest Bylaws, Appeals and Adjudication process. We meet once a month, or every other month as required by workload, and listen to resident appeals regarding fines, assessments, or rules. We make recommendations concerning the same, and from time to time, address specific Rules in the SunCrest Rules that can be improved or updated. We are officially empowered by SunCrest Bylaws Section 4.12 as "The hearing Tribunal." We also provide feedback and support for CCMC, our Homeowners Association Administrators.
We generally meet the second Thursday of the month at 4PM.

TRSSD Budget Approved

Here is my version of Budget Approval meeting at City Hall. I got a chance to speak at the public hearing comments and the city was very accommodating at answering all of my questions.

Amy: I brought up the admin. fee. The cost of $100,000 is excessive and that is about the salary of two full time employees. I understand its a fixed rate of 15% but why not charge it off the actual expenses we incur and not off the revenue. For example this ending fiscal year our expenses were down and we ended up with about an extra $246,000 put into reserves. Why should we have to pay an admin fee to handle the money going into reserves? That would save us about $36,000 if we paid admin fee off the expenses instead of revenue.
City Manager: The percentage is off revenue. Besides you will eventually spend all that money in reserves so it would work the same in the end.
Amy's Thoughts: So we just paid how much in admin fee for the snow blower and stop signs?

Amy: Is is legal that we should be paying benefits to employees that work seasonal for us? (This discussion was answered by several people and I kept saying I understand the salary part, but why should suncrest pay full benefits when those employees work for city too.)
City: Your getting a deal paying for only 3 lower paid salaries. With that comes paying the benefits. We can't just fire and hire people every year. Besides sometimes your getting more help and more experienced and its not always the same people. The salaries equal man hours they put in for SunCrest. So if your paying full time salaries its the law you must pay their benefits too.
Amy's thoughts: I guess what they mean to say is like a school teacher. Paid full time with benefits but gets summer off. Still stupid reasoning because its still only about 30 days out of 365!

Amy: I want verification that the city won't touch our reserve balance and use it toward the SunCrest Fire Station.
City: Right now we don't plan on using it but we haven't really finished discussing the Fire Station issue yet.
City Manager: The reserve funds are to be saved up and used for such things as a salt dome or maintenance facility. If the road issues aren't taken care of it may need to be used to repair some roads. Until we get a new developer up there we don't know how those funds will be spent.
Summerhays: We can use that money for the fire station. I read it in the contract. It states right in the contract we can make you pay for the fire station.
Amy Thoughts: Ah, when is Summerhayes up for re election?

Amy: What happened to the TRSSD committee idea I presented to the council. I have never heard anything else about it. Is that still up for discussion.
Mayor: That really isn't a budget item to talk about.
City Manager: Its still up for discussion as far as I know.

Amy: I want to know if that is a final decision made about the making TRSSD paying for the stop signs? Because those of us that live in SunCrest ALL know those stop signs are there, even in fog. We go through them everyday. Its the non-residents that run the stop signs because they don't see them. So why should SunCrest have to pay for signs that non-residents don't see.
City: Yes, that was decided by unanimous vote by the council to charge the full amount of the signs to the TRSSD. At the time the residents wanted the sign it was said because of fog and weather conditions the sign was needed.
Summerhays: Of course you should pay for the signs. I have lived in high altitudes and even higher than SunCrest. I know what kind of weather you get. Think about that little bit of cost you just paid saved a life.
Amy Thoughs: I think everyone feels the same way as me.

Amy: What happened to the open house you were going to hold for SunCrest residents. Do you still plan on doing this. I can offer my help on planning it.
City: Yes, we still want to do one, maybe in July or August. We just had to get through this budget month.

My comments where finished and Bill Colbert had a comment. He was via phone.
Bill: I think the council should look into privately contracting out the work and see if its cost beneficial.
Summerhays: They already did that once and it didn't work out.
City: It has never been outsource in SunCrest.
Summerhays: Well I mean that Zions contracted it out and we got all kinds of complaints from residents about the crappy work they did and we had to send our guys up to fix it.
Amy Thoughts: Really, hmm, because the city won't set a foot on zions property. Besides it was more like western was plowing the city streets to get through to the ones they had to plow.

Public Hearing: Consideratoin of Resolution TRSSD No. 10-02, Adopting the Traverse Ridget Special Service District Budget and Certified Tax Rate for Fiscal yar 2010-2011.

Now is the time to show up and voice any concerns you have about the budget. I found out that at the council meeting on June 15th, it was decided by Stenquist, Walker, and Summerhayes to apply all of the $24,000 costs of the Stop signs to TRSSD because of our climate conditions. If we as residents continue to just sit back and not voice our concerns about the TRSSD the council members will just continue to tax us more!

On June 1st, I approached the city council during the public comments and presented again the idea of having a TRSSD committee board. I gave each of the council members a copy of the letter posted below. I am trying my best to get us some representation but I need the help of you, the residents to show the council you want to be involved in this special tax SunCrest residents have to pay each year. Please take 15 minutes of your time Tuesday night to the council members to show you have a voice and care about SunCrest.

Letter to Draper City Council:

TRSSD Advisory Committee

Purpose of Advisory Committee is to work with the TRSSD Board and the Draper City Finance Director to review the TRSSD budget and the financials. Upon request from the TRSSD Board the Committee will research issues as needed. Research could be done on major purchases of the TRSSD and finding cost effective ways to use the TRSSD funds, such as snow plowing. The Committee will send all their recommendations to the TRSSD Board.

The Committee will have 3 to 5 members. The committee members must reside in the TRSSD district. The Committee members shall be on a volunteer basis. The Committee chair, appointed by the TRSSD board, shall recommend Committee Members. Committee member terms will normally be for one year. Members may serve two or more years based on experience, requirements, as decided by the TRSSD board of Directors. The TRSSD Board of Directors shall approve the Committee annually. The Committee shall serve under the direction of the TRSSD Board of Directors.

The Committee will meet once a month or as often as necessary. A copy of all the Committee Minutes will be sent to the TRSSD Board in a timely manner.

Reasons the Committee would be beneficial to the TRSSD:
• Give SunCrest residents an opportunity to be involved with the TRSSD tax.
• Once the city takes over the rest of the roads in SunCrest the tax could increase.
• Lots of creative and educated residents that could help find a solution to simplifying Danyce’s complicated tracking system of the snow plow drivers. Therefore reducing the administrative costs associated with TRSSD.
• We could find ways to benefit the TRSSD and city. The portable LED light could be rented or the city buys a portion so it can be used in summer months. Rent snow blower in lower draper.
• The city council members would be the main contact to the residents. The committee would just research and advise on budget issues.
• Research what is most cost effective and reliable on snow removal.

This is also brings up discussions of the SunCrest fire station and SunCrest road repair.

April 13, 2010 City Council APPROVED minutes

Amy Baird requested the council consider options for the TRSSD, including an advisory board consisting of Suncrest residents. The council suggested scheduling a council meeting at a Suncrest station.

Layne Long said the proposed budget is the same document as has been considered adopted during the last two years because the budget has been cut to the bare bones. This document will paint the big picture as to the status of the revenue and expenditures. One component is the special services district. He reviewed the history of the Suncrest fire service and said it is the biggest part of the cost to support the development. He reviewed the master development agreement, noting that the additional cost of the services was anticipated from the beginning. According to the assumptions, the cost of the fire station should be supported when Suncrest is built out. Differential costs are to be covered by the special service district until build out. Mr. Long said the assumptions were wrong to begin with. He then reviewed the creation of the special services district. He noted the creation of fire and EMS district had been discussed but that the district was not created. The TRSSD district which was created does not cover costs for fire services.

Mr. Long said Danyce Steck had calculated figures , based on the development agreement, to show the percentage of tax dollars that goes to the fire protection. The calculation is about $.57 per dollar of property tax collected. If that amount were applied toward the special district, it would be $225,703. Subtracting that amount from the cost of operating the fire station at SunCrest, the city is subsidizing $625,00 every year for the operation of the station. Councilmember Colbert noted that property taxes are not the only revenue. Mr. Long said the ratios would be the same. He said that long term, the funds are not available to operate the city even considering the lean operations. He said the council options are to continue on status quo and fund the station with taxpayer dollars or to add fire service to the special service district. Councilmember Colbert said the risk of residential fire is slim during the winter time so there might not be a need for fire personnel, but EMS is necessary. Mr. Long said the council needs to find a way to reduce the costs or everyone else will continue to subsidize it. Mayor Smith disagreed with Councilmember Colbert about the fire risk. Discussion was held about the intent to pay for fire service and the costs and risks of having or not having fire service. Councilmember Summerhays suggested having another meeting with the Suncrest residents. Mr. Long said the city cannot pay for the key infrastructures if they are paying for the fire-fight services. Mr. Long said a short –term solution would be to leave the TRSSD alone, reduce the tax rate so the surplus goes back to the district residents, and explain to the residents to agree to apply the surplus toward cost of the fire station. This would allow time to work out a long-term solution. Discussion was held about the possible reaction of the citizens and the affect of the ISO and homeowner’s insurance ratings.

Mayor Smith asked the councilmember’s to think about other options. Councilmember Summerhays reiterated his desire to meet with Suncrest residents to discuss this. Councilmember Colbert said the residents will feel they are not responsible for this issue. Mr. Long agreed it makes sense to schedule a meeting at the SunCrest Fire station to talk about the problem, the history, and options. Amy Baird said this year was different because Zion’s Bank plowed some of the streets but those residents still paid the same amount. Danyce Steck explained how costs are allocated to TRSSD. She said this is a very burdensome process. Discussion was held about contracting for all the services, particularly snowplowing.

April 20, 2010 City Council UNAPPROVED minutes (draft)

Councilmember Colbert said there is a piece of curb missing on the Long Branch Drive adjacent to Deer Ridge. At the Suncrest meeting there was a lot of concern about safety issues with SunCrest Drive and other roads regarding striping, flags for snow, and basic maintenance. Another issue expressed is a strong support of the establishing a TRSSD advisory board. He said it has been voted down in the past but may need reconsideration. He said he thinks they need 5 members to work with Danyce Steck on the budget process and make recommendations as far as level of service. Councilmember Rappleye said they would become advisors but would not control the tax fund. Council member Colbert said he is supportive of creating such a board. They need information and understanding.

April 27, 2010 City Council APPROVED minutes

Councilmember Colbert asked if an overlay could be done on Deer Ridge Drive and some portions of Lone Peak Parkway. David Decker said we will try to crack seal it, put fabric down, and do an overlay. The possibility of using TRSSD funds for Deer Ridge Drive was presented.

Mayor Smith said there have been discussions in the past about creating this type of board but it has never gone forward. He said the purpose of the board, number of members, liaison from the council and other items need to be discussed. Councilmember Colbert said there are a number of issues that could benefit from citizen input. He felt there should be 5-7 members. The board would need to meet requirements of the Open Meetings Act and hold regular meetings. Councilmember Stenquist asked why this came up. Councilmember Colbert said questions came up during the budget discussion and there was a desire expressed by Suncrest residents expressed at their homeowner meeting to have their voice heard. Councilmember Stenquist said he understands SunCrest is one of the highest taxes areas in Utah. He said we already have a process for getting information and he is hesitant to add a middle layer between the council and the residents. Councilmember Colbert said there is a strong feeling from those residents to get more involved and to alleviate feelings of disconnect for those residents. Councilmember Stenquist expressed concern, noting that community councils were dissolved because those councils became politicized and started to working counter to the city. Councilmember Colbert said he feels this is different because it is a separate taxing entity. Councilmember Rappleye said he feels it would facilitate better decision making if the special needs of residents are discussed. Councilmember Stenquist said other areas may come forward and request a similar committee for their areas. He said the board members should be appointed and bylaws adopted if a board is created. Mayor Smith said the request keeps coming back. This area has additional needs and costs. Councilmember Colbert said the board needs to be TRSSD, not Suncrest. Councilmember Stenquist said he wants to make sure the SunCrest residents feel comfortable coming to the city council as their elected officials. Councilmember Colbert said this item was put on the study meeting agenda to see if there is enough support to move forward with establishing a board. Mayor Smith asked that this be put on the agenda as a discussion item so the full council can take part in the discussion. Doug Ahlstrom said the board would need to be created by ordinance as specified in the city code. Councilmember’s Colbert and Rappleye stated the board would need to be centered around the TRSSD fund balance.

Mr. Long pointed out the bond on the Suncrest fire station has been paid with the Fire Impact Fee fund. After another year, another source will be needed to pay that bond. Councilmember Colbert added that two additional stations will be needed by the time the city is built out.

The TRSSD fund was noted. No capital projects are proposed from this fund at this time. Funding for the salt dome and fire services need to be discussed. Councilmember Summer hays asked for a continuation of the dialogue about the history of the Suncrest development.

May 11, 2010 City council UNAPPROVED minutes (draft)

Councilmember Summerhays reviewed the purpose of the TRSSD. Doug Ahlstrom explained that the council created the district and set themselves up as the administrative control board. The council can create a citizen’s advisory board that has all the power of the board except the power to tax. Mr. Long said the resolutions creating the board specifies the duties of the board and includes “and any other activities of the district.” Mr. Ahlstrom said the law is specific to require advertisement in the Notice of Intent what is being proposed. Only specified activities can be adopted. Councilmember Walker pointed out the TRSSD can pay for all the road problems because transportation includes snow removal, street lighting services , repairing and maintaining roads. Mr. Ahlstrom said everyone is taxed at a certain level, and TRSSD puts in the extra amount. Mr. Long said that is the understanding, but that is not what the resolution says. Councilmember Colbert urged equity. Mr. Ahlstrom agreed with Mr. Long, stating the resolution mimics the notice of intent, which is copied straight out of state law. Mr. Long said from legal point of view, what was adopted is not what had been discussed. Councilmember Colbert said one solution is to have one resident from the district appointed to the TRSSD board as a voting member. That would give representation and gives a voice of the district residents. Councilmember Walker said the council represents everyone in the city. He said the tax rate for the entire city is affected by the district. The district is a neighborhood with significant problems such as the fire station and the roads. Those problems will break the budget for the entire city. He said the budget meetings are open and the city is transparent with the money and its public clamor that some of the district residents don’t trust the council/board. Councilmember Colbert replied the TRSSD is the highest taxed entity in the state, and one vote won’t change anything. Discussion was held about the fire station history and fire protection. Councilmember Walker said the ultimate goal of some TRSSD residents is to eliminate the district. Councilmember Summerhays said he would like to have a meeting at Suncrest to discuss this. Mr. Long said the council needs to resolve in their minds how they want to address this before meeting with residents.

SunCrest Community Clean up day/ Blood Drive

Just a reminder that we need volunteers to help clean up the next Saturday, May 22nd.

This is a way for the residents to volunteer their time to help clean up after the winter and make SunCrest beautiful again. If we don't get enough volunteers to help then it may have to be contracted out and we can pay for it instead....hmmmm...I am thinking a hour of my time is better than paying for someone else to do it.

We need help painting and repairing bridges, picnic tables and the gazebo in the Village Park Green. The OA will provide all the supplies. It would also be great if you can't attend during that time to just pick up some trash around your neighborhood during the weekend and throw it in the dumpster. Every little bit helps.

It states we still have 3 full time salaried snow plow drivers with paid benefits. The line items that say CLOSED mean they aren't be budgeted for anymore. Re: Traverse Ridge Special Services District

Draper City Council:

Draper City Council has been discussing ideas on how the Council could receive feedback from Draper residents living within the Traverse Ridge Special Services District (“TRSSD”) boundaries, concerning decisions on how to spend TRSSD funds. As a Draper resident living in the TRSSD, I would like you to consider the following:

The Utah Legislature created the Utah Special Service District Act allowing local governmental entities the ability to create a “special service district” for limited purposes. Utah Code Ann. § 17D-1-101. The special service district is a “body corporate and politic with perpetual succession” that is “separate and distinct” from the municipality that creates it. Section 17D-1-103(1)(a). Generally, a special service district is allowed to provide services “that the governing body determines will more effectively carry out the purposes of the special services district.” Section 17D-1–103(2)(q).

Approximately 12 years ago, the Traverse Ridge Special Services District was created through a partnership between the City of Draper and the developer of SunCrest for the purpose of providing a mechanism whereby the property owners within the district could be provided additional city services as necessary to address the special needs of the subdivision because of its elevation in relation to the rest of the city. Since that time, the city has wholly administered the TRSSD. With approximately 1,000 households now living within the TRSSD, this may be a good time for the city to consider other options in how it administers the TRSSD.

When the Utah Legislature created the Utah Special Service District Act, it also provided a system whereby a political subdivision could oversee a special service district and also allow those who reside within the special service district the ability to be involved in the decisions that impact their special service district. TRSSD is governed by the City of Draper, but the Act allows the city to delegate certain rights, powers, or authority to an administrative control board (“Board”). Utah Code Ann. § 17D-1-301(1). The Board may “exercise any right, power, or authority that the legislative body possesses with respect to the governance of the special service district” except for certain delineated powers listed in the Act (annex an area, levy a tax, levy an assessment, etc.). Section 17D-1-302, -303.

The Act provides that the municipal legislative body that creates the Board “may provide for board members to be elected or appointed, or for some members to be elected and some appointed.” Utah Code Ann.. § 17D-1-303(1). The city has discretion on who to appoint to the Board, and for elected members of the Board, they must either be (1) a registered voter within the special service district; or (2) an officer or employee of the municipality that created the special service district. Section 17D-1-304(1)(a).

If one were to inquire of the Draper residents living within the SunCrest subdivision what their greatest concern is regarding the TRSSD, the answer would be that we are concerned about how TRSSD funds are spent. There is a perception by some that TRSSD funds are used for improper purposes. It is obvious that better communication needs to take place between the City of Draper and SunCrest residents, and with a town meeting held in SunCrest last year and another town meeting planned in SunCrest in 2010, the city is making great strides on this issue.

However, I believe the only real solution for the twin problems of mistrust of how TRSSD funds are spent and better communication with SunCrest residents, is to make use of the solution the Utah Legislature has provided in the Special Service District Act: Elect or appoint registered voters living in the TRSSD to serve on the Board.

Currently the TRSSD Board is composed of six individuals: the five members of Draper City Council and the Mayor of Draper. Changing the composition of the Board to include one, three, or even five appointed or elected individuals from the TRSSD would still allow the City of Draper to still have majority control of the Board. But more importantly, such a makeup would allow TRSSD residents to be actively involved in the discussions and actual votes of the Board, giving the SunCrest community a greater voice in how their tax funds are utilized. It is also in line with the basic conservative principle that the closer the government can come to those who are governed, the greater the opportunity for them to direct how they are governed.

As noted previously, it is important to recognize that the Act provides that all rights, powers, and authority for the TRSSD Board are delegated to it from Draper City Council, and Draper City Council must retain certain rights. Further, according to the Act, Draper City Council may “at any time modify, limit, or revoke any right, power, or authority delegated to the administrative control board.” Utah Code § 17D-1-301(4)(a).

Concerning the proposal for a TRSSD advisory board, I agree with several Draper City Councilmen who have opined that the advisory board would have the effect of adding an extra layer of government between SunCrest residents and the City of Draper. Additionally, while having an advisory board is certainly a step closer to having SunCrest residents more involved with the City of Draper, members of the advisory board would only have the ability to “advise” as opposed to actually being able to vote for action items brought before the TRSSD Board.

Accordingly, please consider this proposal to include TRSSD residents on the TRSSD Board as you discuss how best to involve SunCrest residents with decisions of the Board. Thank you for your time and consideration.

City Council Meeting on TRSSD advisory board

Paul Tonks and I attended the Draper City Council meeting last night. (April 27th) They had on the agenda as a study item to discuss having a SunCrest (TRSSD) Advisory Board. Since this was just a discussion between city council members no public comments can be given…isn’t that nice! So here is the outcome of the discussion: Colbert , Rappleye, and Mayor Smith wanted an advisory board for TRSSD. Stenquist was strongly against it. He commented that they had a Community advisory board before and it turned political and problems developed so it had to be dissolved. Cobert commented that the previous Community advisory board was different and that the council didn’t handle their funds. TRSSD is special because the SunCrest residents pay this special tax and feel they don’t have a say about it. Rappeleye, made some great comments saying the advisory board could do the research on stuff like stop signs and using a private vendor. Stenquist was still was against it saying we didn’t need another layer of government. We voted in the city council members so we should trust them to make the right decisions with our funds. Stenquist also said if we have concerns about our special tax then we should talk directly to city council. Summerhays seemed to be leaning more against it but was on the fence. He wanted more information and how Walker felt. Walker wasn’t at the city council meeting so we don’t know his feelings. But it has been heard he is against it and voted against it last time it was brought up. So the city council decided it needed further discussion and can be voted on at a later city council meeting.

It was brought up about holding a town hall meeting for the SunCrest Residents. It was said that there isn’t time in May and maybe they could fit it in June? (yeah…after our budget is already been approved!)

You don’t know how hard it was to have to sit there and not be able to say anything. The comments made by the city council people that I wrote weren’t word for word but the way I heard and remembered by my memory. I could tell that Colbert and Rappleye really heard our voices at the meeting and want to help us. They believe we have concerns that need to be addressed and have some great ideas. They tried hard to convince the other councilmen. I don’t know how talking directly to city council about our concerns work as Jeff Stenquist advised? I have been emailing and talking to them and I just seem ignored. We even held the SunCrest residents meeting the other week to express our concerns. I mean really what more else can we do to EXPRESS our concerns about TRSSD? Do we need to email and call them every day until they listen! Alright, I am not telling you to do that.

Mr. Tonks suggested that we have a right to have a SunCrest resident on the actual board. There are state statues to back this up. Of course he wasn’t allowed to speak last night to show the council of his findings and that we want an actual SunCrest resident on the VOTING TRSSD budget board. I would love to have that but I think an advisory board would be great too. A group of 5 residents volunteering their time to research items like, stop signs, do we need or want a salt dome, would it be worth switching to a private vendor verses the city workers. There are so many things we can do and reach out to residents to hear what they want. We are offering our FREE service to the city.

I wanted to know if anyone has some suggestions on how to fight the stop sign issue. We all love the new blinking stop signs but the $24,000 for those signs shouldn’t have been taken out of the TRSSD fund. HELLO..they are stop signs, which should be out of the general fund. We need a good argument to present to council to have them refund us back on those signs. They say it’s because of fog and snow we needed those lights to see the signs. Yes, that is nice and all but I thought most accidents and traffic tickets occurred when people (mostly non residents) come up to the crest of the hill and didn’t even see them and ran through them in the middle of a nice day. Do we have anyone interested in getting those public police records of accidents and tickets at that intersection over the past couple of years? Let me know if you can think of something special that was done for traffic or something else unusual that the city had to do for LOWER Draper. Anything we can do to prove the point we shouldn’t have to pay for them.

Please look for further updates. Once we see the Advisory Board come up on the agenda again we want to notify everyone so we can fill that city hall and express our concerns. We will also have more information about our rights when it comes to a Special District tax.

SunCrest Residents Meeting

I wanted to thank everyone for the great turn out. I would say about 80-100 people? The meeting started at 7pm and ended at 10:30pm. I hope everyone got a good education on what is the Traverse Ridge Tax (TRSSD). I did hear a few people confused on my point of this meeting. So let me clarify again why I called the meeting.

1. I wanted to educate you on the tax you pay.
.
2. I had the City Finance Director, Danyce explain the budget and where your money goes.

3. I wanted it pointed out that we paid a fixed fee of three salaries and administrative expense which is close to half our budget. Like about $250,000 out of the $500,000 budget. Last winter we paid that same fixed price as this winter. But....last year the city plowed ALL of SunCrest and this year only half of SunCrest. So why should we pay the same price for half the service?

4. I wanted to introduce the company (Great Western) that plows Utah County for Zions bank. Because I think it would be more cost effective if we hire out private and pay for the services we receive and eliminate the fixed costs we currently pay.

5. I wanted to recommend a SunCrest resident advisory board to help the City Council with this budget. Be the voice for the residents. This was brought up before and the City Council voted it down. I think after tonight’s meeting it will happen.

6. I wanted some accountability of why should we pay for those $24,000 flashing stop light signs out of the TRSSD…..I was told because lower Draper doesn’t have fog so that isn’t something that would have been purchased for the city.

7. I saved this part for the end of the meeting because I didn’t want everyone angry and just talking about this issue. But when I met with the city council on Tuesday, they mentioned that they don’t have the funds in tune to around $850,000 a year to support our fire station. They had pulled up city minutes dating back to 1998 when the SunCrest developer talked with the City Council about including a fire station and the expenses in the TRSSD. Then in 1999 the city council approves the TRSSD tax without any mention of fire safety or station. So the City Manager was considering, now just thinking out loud, to see if the TRSSD fund could pay for it now. I got very angry and told them not to touch our money and shut it down before you make just the SunCrest residents pay for it. I did bring this up at the meeting tonight and the city council said they will find other ways to fund that fire station and not ask us for the funds. So hey if you have any suggestions of where that money can come from please let the city council know.

Several residents brought up some great issues. Like the safety of SunCrest drive. The lines need to be painted in the road because you can’t see them in a storm. The Council said that is private property of Zions and that is Zion’s responsibility. But they would take it to the council to talk to Zion’s to see if they can maybe get permission to do it. But then again, it’s a private road and why should the city pay for stripping. Well, my opinion is the city had no problem plowing the lines off on SunCrest drive the past few years, what is the big deal to replace it?

The city will hold a town hall meeting sometime in May for the residents of SunCrest.

Councilman Colbert and Rappleye did a great job at answering questions, as did Danyce. They even told us that the other councilman couldn’t attend tonight because they were in an executive meeting right now to work out some SunCrest issues. Hopefully, within in the next several months we will start to see improvements with the lawsuit. The biggest hurdle is to solve the SunCrest Drive issue. The city hopes to see a developer in here and finish building out SunCrest.

My last goal was to get the residents to come up with some suggestions on how to reduce this budget. So let me know ideas you have besides making it disappear because sorry but its here to stay. But at least we should get a voice on how it’s spent.

Suncrest OA budget meeting notes

(I just made some corrections that came from the SunCrest management office)

Here are some of the notes that I took from the meeting last night. It included a line by line explanation of the budget and rather than posting that detail I thought I might pass along some what I found important.

1. Approximately 1100 homes built in Suncrest and 250 lots.

2. Of the $98.00 HOA fee approximately $33 passes through to comcast for internet and basic cable, leaving approximately $65 for operational expenses.

3. 65 homes went to distressed sale in 2009 *(Only 50 homes went to Trustee’s Sale, 10 Home Owners filed for bankruptcy) (just as an add on 117 total homes were sold in Suncrest in '09 compared to 50 in '08 and 160+ in '07 according to the MLS).*SunCrest has documented 105 Re-sales in 2008 & 157 in 2009. I don’t know how MLS compiles it’s #’s, but they are very different than the actual Deeds we recorded.

4. Dues that were not paid in '08 resulted in $84k written off and $150k in '09. *NO-Write-off’s in 2009 were budgeted at $86k in 2009, but $104K was actually approved by the Board for Write-Off’s. $150k is what is budgeted for write-off’s in 2010

5. Total proposed budget for 2010 is: $1,158,909.00

6. How much would it cost to get the clubhouse to a certificate of occupancy? *Estimates have come in around $500k and that would not include any furnishings, equipment, or supplies for operation according to a feasibility study done by Zions Bank.. * Extensive Landscape plan were previously approved for the Clubhouse by Draper City, and they have not agreed to modify the original plans for cost savings

7. What is the status of the lawsuit? Discovery phase with no disclosed talks of a settlement.

8. How is Suncrest doing compared to other HOA's locally and nationwide. There are many that are seeing budget short falls of up to 20-30% and assessments are having to make up the difference. In failed master planned communities where the developers have defaulted many banks have not taken the community back and are simply not picking up the tab to take care of the assets in some places.

9. There is some evidence that Zions has begun to take care of the punch list that they were given by the city to get the development up to their standards.

10. *This was not discussed at the Budget meeting, but good information:
For those that don't know, it was explained to me that the reason that Alpine School District is the only school district that will bus students is because the State has a law that states that school buses cannot drive up a road of 10% or more grade for safety reasons. Canyon and Jordan cannot therefore offer the service on the north side and on the south side the grades do not reach 10%. Therefore there was an agreement reached that a per student amount is paid by the northern districts to the Alpine district on the south in renumeration for their expenses.

11. LUDs are "limited use driveways" that have their own unique snow removal needs and therefore pay $75 per month for that because *they are private streets and not owned or maintained by the City the city will not use the special service district resources to pay for that.

Daddy Daughter Date Night

Dads and daughters come and enjoy a fun night out in SunCrest at the 2nd annual Daddy Daughter Date Night! On Friday, February 5 from 6:30-8:30pm Dads and Daughters are invited to the Information Center for a fun night of crafts, music, dancing and refreshments. A photo will be taken of each couple to be placed in a special Valentines frame. Each girl will receive a Corsage and a Valentine gift bag. Pre-registration is required for this event. There is a $8 fee per Dad/daughter, $2 for each additional sibling. Please pre-register at the Association Office. Registration deadline is Friday, January 29. Don’t miss this fun night out! SunCrest Town Hall Meeting

The next SunCrest Town Hall meeting is scheduled for Wednesday, January 13 starting at 6pm. The meeting will be held in the Draper City Council Chambers at Draper City Hall (1020 East Pioneer Road). Community Manager, Tod Bean , will be doing a presentation from 6:00-7:00pm. We will be answering any questions you may have afterwards in the lobby of City Hall. Please plan to attend if you can.

Draper Peer Court

The Draper Peer Court is now being formed and accepting applications!

The Draper Peer Court is seeking youth volunteers and adult advisors.

Youth Volunteer Applications are due December 11th.

What is the Draper Peer Court?

The Draper peer court offers an alternative approach to juvenile justice in which youth referred for minor offenses are sentenced by a jury of their peers. Peer Court employs a restorative justice-based approach that applies the skills and abilities of Draper City juveniles to provide positive peer influence, to hold youth accountable for their actions, and to strengthen their ties to school and community.

Youth Volunteers
Peer Court utilizes the skills and abilities of a diverse population of Draper youth. The program helps to eliminate geographical and social barriers and unites youth throughout the city as they collaborate to intervene with referred youth. This program presents a model for the belief that diverse group of students can work together and come to a consensus on clear, positive standards for behavior. As mentors, role models, and as key players in their community, they realize they can make a difference in their own and others' lives.

Adult Volunteers (Advisors)
Advisors are an integral component of the program. Their role is strictly advisory, as the title implies. They offer guidance,when needed, and debrief panel members after the hearings. They also monitor the mentoring process with the mentors and the referred youth's parents. The goal of this position is to foster an environment that empowers the students to take ownership of processing the issues that come before them and assist in the ongoing learning process.

Lost Cat

LOST - "Chili" 10 year old male orange tabby cat. Disappeared Sunday November 8th in Southfield neighborhood at Suncrest. Wearing an orange collar and name tag at the time he disappeared (although he may have lost the collar if he got stuck somewhere). He is microchipped. SunCrest child care co-op

We have started a FREE child care exchange program that is open to SunCrest residents only. Co-op members are SunCrest moms, not licensed providers. For more informatin or to join the co-op, please email Kelly Nelson at knelson915@sbcglobal.net

This is a great program if you need a break during the day or just want a date night. You pay or earn a coupon dollar an hour for each child. So if you watch siblings of two for three hours you just earned six hours of coupons.

4-way Stop Sign

Dear Residents,

Driving home last night at 8:30 pm was challenging, with visibility down to 20 feet or so through the fog and snow. It was hard to see the "Stop" sign at the four-way intersection at Traverse Ridge Road, SunCrest Drive, and Deer Ridge. Even in good weather, many of us have seen vehicles go through that intersection without stopping, some without slowing at all. This is a hazard for other motorists and especially for pedestrians trying to cross the intersection.

There have been accidents there before, and will be again unless something is done to increase the visibility of the "Stop" signs. I have asked the Draper City Council to consider installing flashing stop signs at that intersection (just lighted stop signs, not a traffic signal or overhead light). The Council is considering a solar-powered model, which may be cheaper to operate and easier to install than running underground electric cables to the signs.

The Council will be discussing this issue at their next meeting, this coming Tuesday beginning at 7 pm in the Council chambers at Draper City Hall on Pioneer Road. If you have an opinion regarding this proposal, please let me know or consider attending and speaking to the City Council during the citizen comment period. This is a chance to make our voices heard and ask Council members to respond to citizens' concerns.
In fact, the Council may not act unless it is evident that many of us support this proposal.

SunCrest Spooktacular

It’s that time of year again! Time for the 3rd annual community Halloween Spooktacular. Dress up in your costume and join your neighbors for some Halloween fun on Saturday, October 24. We will hold the Trunk-Or-Treat from 3:00-3:30 p.m. in the Community Center parking lot. The Owners Association will be handing out goody bags during the Trunk-or-Treat while supplies last. Following the Trunk-Or-Treat at 3:45 p.m., Paul Brewer the magician will be performing in the SunCrest Information Center. To learn more about Paul and his show please visit his website at www.utahmagic.com. We will also be serving refreshments during the magic show. This event is free for SunCrest residents. If you are interested in decorating your trunk and handing out candy for the Trunk-Or-Treat please be set up by 3:00 p.m. in the Community Center parking lot at 2016 E. Village Green Circle.

Board of Trustees Quarterly Meeting Time

At the last Board of Trustees meeting held on Tuesday, September 15, Zions Bank was pleased to announced the meeting time for future board meetings will be moved from 3:00 p.m. to 6:00 p.m.! Zions bank hopes that by changing the meeting to a later time, more residents will be able to attend. Please note, the next board meeting is scheduled for Tuesday, December 15 at 6:00 p.m.

Frightmares at Lagoon

SunCrest Owners Association has discount tickets for Frightmares at Lagoon. These discount tickets are $21.95 for ages 3 & under and $29.50 for 4 years old & up. You can obtain the discount tickets at the Owners Association office Monday-Friday 8:00-5:00 p.m. There is no purchase necessary when you pick up the ticket. Each ticket is good for up to eight people.

Bus Stop at the Information Center

Volunteers that help direct traffic before and after school for the grade school busses need your help. Drop-off and pick-up at the Information Center has become very congested. It has made it difficult for the busses to enter and exit Village Green Circle and get the children to school on time. To help reduce the congestion, traffic volunteers ask that you treat the Village Green as a one way road entering from Traverse Ridge Road and exiting out Deer Ridge Drive. Thank you for your help in this matter.

Neighborhood Watch Program Update

In the happenings mailing on 9-25-09 we talked a little about Neighborhood Watch Programs. If you are interested in starting a neighborhood watch group for your neighborhood please visit the following website for instructions on starting www.draper.ut.us. Once on the website, select Public Safety then Police then Neighborhood Watch.

Fire Hydrant Snow Removal

The colder weather is here and the snow is close behind. Please remember that if you have a fire hydrant in front of your home you are responsible to keep it clear of snow by city ordinance. The city ordinance states that there must be a three-foot clear space around the circumference of the fire hydrant. For more information please see Draper City’s website at www.draper.ut.us.

“Good Night Chairs”

Now is a good time to be cleaning, covering, and storing your patio furniture and outdoor grill. If you can, get in that one last barbeque, but then safely shut off the propane tank, store the charcoal briquettes in a safe place, and learn to make S’mores inside. Be sure to drain any portable fountains, and carefully shut down your outdoor water features (or have a professional do so). Any leaks should be addressed NOW, before winter freezing has a chance to enlarge them.

A Message From Greg Powers

A message to the residents of SunCrest from one of the candidates, Greg Powers, who is running for City Council:

I am running for Draper City Council and would appreciate if you could help me get the word out to SunCrest residents about where I stand in regards to their situation. If you could forward this message on to the members of your group I would appreciate it.

As of now we are in litigation and I don't know how it will turn out. I'm sure we will find many things the council could have done better in hind sight, but I'd like to address the future of SunCrest.

The council members are elected at large, therefore the city as a whole is responsible for their election. It was mistakes and misunderstandings between the council and SunCrest and Zions that would cause us to have to pay out a settlement, not mistakes from SunCrest residents. They are no more responsible than any other Draper resident who voted for the council members who made the mistake.

Whatever it turns out the mistakes were what got us into this, we all voted for those who were involved in the misunderstanding, whether we live in SunCrest or not we are responsible. So if there is a settlement between Draper and Zions all of Draper needs to pay it. The residents may not like it, but if they don't they should be upset with the council, not SunCrest residents.

I have a long time family friend who lives in SunCrest and I visit there often, we are all part of one community and we need to stand up, take responsibility for who we elected, and slug this out together. We are not SunCrest residents and Draper Residents.

Middle School Bus Resolution

Attention: Suncrest Timberline Middle School Parents & Students

Beginning tomorrow morning Sept. 1^st, the middle school students will have two buses to transport them in both directions. The district has allocated bus #675 (the question mark bus with Alberto as driver) and bus #710 (State of Utah bus with Doug as driver) to our SunCrest route. Two requests from the district are that the Mercer Reserve (Winged Trace) students continue to board the question mark bus as he will be making the stop at the designated spot. Also, once the student has chosen a bus to ride, they are asking that the student continue to ride that bus throughout the school year. This will help to better track the students in the event of an emergency.

Thank you for your patience while the district worked to resolve the crowding issue.

Middle School Bus Information

Attn: Parents of Timberline Middle School Students

Please know that the District Transportation Office is aware of our concerns about the crowded bus situation in Suncrest and is working to remedy the problem by week's end. They are looking at buses/drivers/routes in order to find a driver and bus that is available to be a second bus for the middle school students in the morning. They have found a temporary solution for the return trip home so there will be a second bus (the snowflake bus) starting today to bring the kids home. But for now, the morning ride will require a little squishing and patience for those at the Information Center bus stop. They will be making a second morning run to pick up the kids at the Southfield bus stop.

Parents, please be patient and know that the transportation dept is working diligently to come up with a solution quickly.

Please note that this ‘temporary solution’ might affect the time that the Snowflake bus drops off the Ridgeline Elementary children in the afternoon…hopefully only by a few minutes.

Bus Stop Volunteers needed!

On Monday morning, bus passes will be distributed to Ridgeline Elementary students.
Sara Kocsis, SunCrest Transportation Safety Committe Chair, has asked for several volunteers to be at the bus stop in the morning for both A and B tracks to do the following: 1. check names of students against lists of which bus they rode last year and 2. distribute the appropriate bus pass.
This is a one time volunteer request.

A Track volunteers need to be at the bus stop at 7:15 am
B Track volunteers need to be at the bus stop at 8:30 am

A few important reminders regarding the Suncrest Bus Stop!

Bus Assignments/Passes
We have been notified by Dr. Higgins (Principal) that last year’s bus assignments are being carried over. Therefore, we need all children to ride the same bus they were assigned to last year.

Bus passes will be made and handed out again soon. Each child needs to keep this bus pass on their backpacks throughout the year. If they are riding home with a friend on a different bus, they need a letter of permission from their parent to ride the bus.

Also, I am in desperate need of volunteers to help me assemble the 600 bus passes needed this year. Please call me if you can help! (Sarah Kocsis – 801.601.8889)

Pick-up and drop-off times

The District Transportation Office needs parents to drop off children 5 minutes BEFORE buses arrive. This allows traffic to clear before buses enter the Market entrance, permitting buses to load and depart on schedule and avoid unnecessary danger to our children. This will also alleviate the identified safety hazard of unsupervised children approaching through the traffic area.

Thank you to all my bus stop volunteers that we’ve had for the past 2 years. We are hoping to not NEED volunteers this year. SunCrest Daisy Girl Scout Troop

We are trying to start a Daisy Girl Scout Troop in SunCrest.

Daisy Girl Scouts meet in groups of five to 10 with two or more adult leaders in a nurturing, inclusive environment. They go on trips, learn about nature and science, and explore the arts and their communities. Daisy Girl Scouts can also earn Learning Petals and receive participation patches.

There is somewhat of a course outline of what the girls need to accomplish in order earn their badges. We need to be 6-12 girls registered to start a troop.
Our thoughts are that if there was a troop in SunCrest and there were at least four volunteer Moms/Dads then it would be easy to pull off. If there were four volunteers then each of us could be in charge of a week a month and it would not be too much of a burden on anyone. Elizabeth Sweat is happy to be a volunteer if there is enough support/interest in starting a troop and Nancy Bromfield will be the co-leader. There is a $12 annual fee through Girl Scouts of the USA (for insurance/liability purposes); and Nancy's daughter who was in another Daisy troop paid monthly dues of $5.
On Saturday, July 18 there will be information gathering for parents and an activity for the girls at the Girl Scout headquarters. It will be held from 10 a.m. - 12:00 p.m. ~ 445 East 4500 South ~ Murray.

Vacation Rentals in SunCrest

Several of you have had occasion to make complaints to the OA about homes in their neighborhood being used as “vacation rentals.” Although home businesses are allowed in SunCrest if they follow certain rigorous guidelines, this does not extend to allowing homes to be used as short-term vacation rentals. SunCrest is and will remain a residential community. Homes must be leased for at least six months (or longer), AND the lease must specify that renters have been provided with a copy of the governing documents AND agree to abide by all rules and by-laws. (See CC&Rs 4.2.32, 4.2.32, 4.3.1, and 4.3.2).

Vacation rentals create increased traffic in a neighborhood, the presence of individuals who are unknown to the other residents and who often are unaware of the rules. On occasion, there can be even more serious problems. If you are aware of homes that are being rented out short-term as a vacation getaway, please let Tod or Mary know by either calling the office at 801-572-1233 or email tbean@ccmcnet.com.

OA Board Meeting Summary

The following is a summary of the OA Board Meeting held on June 16, 2009:

Board of Directors: Ralph Matson, Barbara Blackmer, and Gena Jones (via
telephone) participated. Ralph Matson announced that Mark Holliday and Robert Brough would no longer be on the Board. Zions Bank has not yet appointed their replacements. Community Manager Tod Bean answered
homeowner questions on several topics. After tabling the election of
OA Officers at the last two quarterly Board meetings, Zions' OA Board members proposed the election of Gena Jones as President of the Owners Association, with Ralph Matson as Vice-President and Treasurer. The motion carried, with Barbara Blackmer abstaining. A Secretary has not yet been elected.

Board members voted unanimously to ratify the Comcast Bulk Service Agreement. Barbara Blackmer noted that one homeowner opposed the assignment of the contract to the OA in the federal Bankruptcy Court, which cost the OA an additional $2-3 thousand in legal fees. The Board voted unanimously to renew the landscape contract with Kimball Property Maintenance. While the Board approved the charter for the OA's advisory Landscaping Committee (which will be comprised of residents), Ralph Matson tabled the proposed appointment of a resident as Chair of the Committee. Manager Tod Bean proposed a draft Self-Help Enforcement Policy to address circumstances such as unapproved structures blocking drainage swales (which property owners have refused to remove) and similarly serious violations. Ralph Matson tabled the proposal for further review. The next meeting of the Board of Directors is September 15, 2009 at 3 p.m. at the Information Center.

Zions Bank Filed Lawsuit Against Draper

According to what I have been told, Zions Bank filed this lawsuit on June 11. It's only hitting the media now, but it seems that Zions has no intention of either hiding or publicizing their intentions, giving us not much information to go on. At the most recent SunCrest Owners Association meeting of the Board of Trustees, Ralph Matson informed us that two trustees associated with Zions Bank would no longer hold the position of trustee. That leaves just two individuals from Zions Bank on the Board of Trustees, Ralph Matson and Gena Jones. Ralph's email address is Ralph.Matson@zionsbank.com and Gena's email is Gena.Jones@zionsbank.com if you have any questions regarding the SunCrest development that I cannot answer, or if you have any questions you would like addressed directly by a representative from Zions Bank. Zions Bank has not kept the OA nor SunCrest homeowners, informed about these recent developments, including the lawsuit.

If you read the comments attached to this article, you will find the usual assortment of SunCrest-bashing, poorly informed and filled with hate. While I find these false allegations very offensive, I try to remember that we live in a beautiful, unique place. Almost everyone who lives here behaves in a friendly, neighborly way. Almost everyone tries hard to follow the rules and guidelines, to be considerate of each other, and to behave with maturity and honor. There may be some rough days ahead, filled with nasty insinuations that will be eagerly repeated by a few reporters desperate to fuel conflict. It's only my opinion, I know, but I'd love to see us all behave with dignity and decency in keeping with our lofty surrounds. We already have the mountains -- let's not hack things down to molehills, please.

Zion's Bank sues Draper over SunCrest

Zion's First National Bank has filed a $25 million suit against Draper in 3rd District Court, alleging the city mismanaged the 4,000-acre SunCrest development that is now in bankruptcy.

"Draper appeared to be poorly managed, overwhelmed by the size and scope of the development and repeatedly failed to comply with its obligations to SunCrest ... " the suit states.

The city's "interference and wrongful acts" eventually led SunCrest to bankruptcy, the suit claims.

"SunCrest defaulted on loans and ultimately represented to Zions Bank that it had no intention of curing its defaults."

Further, the action states that Draper "repeatedly sabotaged negotiations with potential developers" to take over the development.

Draper officials could not immediately be reached Thursday morning for comment.

The suit states that Draper's failure to perform its obligations as required by the SunCrest agreements have damaged Zion's Bank in an amount no less than $25 million.

Landscape Committee

Sun Crest OA is looking for Residents that would be interested in joining our Landscape Committee. The Landscape Committee will focus mainly on landscape improvement projects and community clean-up throughout the community.

Some Utah County residents have received Out-of-Area Transfer Student Request Forms. Salt Lake County needs to fill out the form in order to appropriate funding from The Canyons District, but we are working to update the form so it's in compliance with HB 349.

SunCrest Cell Tower

At the SunCrestResidents.org Meeting on Tuesday, the Verizon team came and gave us a presentation on possible tower sites.

Here is some information on the presentation:

In our previous discussions regarding the cell site in the Suncrest Development, you mentioned that Zions may be amendable to looking at an alternative location outside of the park. In reviewing the municipal code and talking with Draper City staff, there is the opportunity to place a stealth monopine in the area behind the Fire Station and Community Pool near the weather station or even up near the location of the construction trailers along Traverse Ridge Road. I have attached a copy of an aerial showing the locations that I am referring too. VZW would propose to install a minimum 60’ monopine with a minimum 30’ x 40’ lease for the placement of the monopine and equipment shelter. For a multiple carrier site the lease area will need to be increased. I have attached a copy of some sample monopines for your use.

We’ve rescued 4 little kittens from the roof of the clubhouse over the last couple of days (yes-the roof!). We’ve got a gray kitten and a black kitten that need a good home! They’re both females. We’re guessing they’re probably about 4 weeks old, so they will need to be bottle fed for another two weeks or so. The Humane Society and Draper Animal Control said if we take them in, it is very likely they would be euthanized, because of their young age and they can’t adopt out kittens until they’re 8 weeks. All shelters are overloaded right now and we haven’t found anyone to foster them (besides Claudia and I) We haven’t had the heart to take them somewhere where they might be put down. 801.572.1233 Call and let Mary or Claudia know if there's any way that you can help take care of these kittens.

SunCrest Homeowners,

Every year SunCrest homeowners elect Voting Delegate(s) from each neighborhood (Oak Vista, Eagle Crest, The Pointe, Mercer Reserve, Deer Ridge, SouthField, Stoneleigh Heights, The Cove, Tallwoods, The Cottages @ Eagle Point, Canyon Heights, Eagle Ridge). These Delegates are elected by you, other homeowners and Lot owners of SunCrest. Delegate Nomination Applications were mailed to each home/lot owner of SunCrest but the OA would like to provide as many options as possible to make it easy to register. Please note the application deadline is Friday, May 8th at or before 5:00 pm. If you would like the OA to email you an application, please email Community Manger, Tod Bean at tbean@ccmcnet.com. You can also fax your application to 801.572.9349, return by email, or drop the form off at the Information Center before the deadline.

Delegates are elected for every 50 Lots and all neighborhood Lots are rounded to the nearest 50. For example, if there are 49 lots there is 1 Voting Delegate; if there are 75 Lots, there is 1 Voting Delegate; if there are 76 Lots, there is 2 Voting Delegates. It should also be noted that alternate Voting Delegates will be elected for each neighborhood in the event a Voting Delegate is absent because Delegates must be present in order to vote. Alternate Voting Delegates are selected by the runners-up. Responsibilities of Voting Delegates include introducing yourself to current residents, new residents, voting/polling by the OA or Board of Directors on association matters, electing homeowner(s) to the Board of Directors when a seat is open and representing your neighborhood in the best interest of the Community.

After all Voting Delegate applications are received, SunCrest OA will send out a ballot which will list all homeowners wanting to become your Voting Delegate. This Ballot will be mailed during the week of May 11, 2009 to all home/lot owners. This Ballot must be received by SunCrest OA no later than May 22, 2009. However, before you cast your vote it is recommended that you attend a meeting conducted by SunCrestresidents.org to “Meet the Delegates Night” on Tuesday, May 19th at 7:00 pm at the Information Center. It is recommended that all Delegates attend this meeting to introduce yourself, what neighborhood your represent and quickly explain why you would like to become a Voting Delegate.

All elected Voting Delegates will be notified immediately following the Annual Meeting which will be conducted on Wednesday, June 3rd at 6:00 pm at the Draper City Hall Council Chambers.

Comcast Rumors

Regarding the new Comcast contract, there have been some pretty extraordinary rumors floating around, one of them being that if Comcast cuts off service due to non-payment of OA dues, the individual can just contact Comcast privately and have their service set up that way. Mary Chamberlain of the OA checked into that rumor, and this is the recap of her conversation with Comcast:

I just wanted to let you know that I just had a nice long chat with Lisa from Comcast. I told her of some residents' claims that they can set up their own service with Comcast and that Comcast reps have stated that they can do that. Lisa said no-absolutely not. If a Resident lives in Sun Crest, Comcast is unable to set them up with basic services without billing it under the bulk agreement. She said even if someone is told something different with customer service, they will not be able to set it up as an individual account if they try. She said some residentts do have upgraded movie channels and DVR services under their own names, but basic service is under the Sun Crest bulk agreement. How ironic that some residents accepts the Comcast services, but vehemently refuse to pay for them. Lisa also stated that once we request to have a resident's bulk services shut off, the entire box goes dead -- meaning it will turn off everything, including DVR, movies, and internet. It's as easy as sending an e-mail that a resident is not paying their OA dues, and the services are shut off.

I am very happy to report that this morning, the bankruptcy judge approved the assignment of the Comcast bulk services agreement to the OA. This means that residents will continue to get cable TV and high-speed internet service at the low rate given in the OA's 2009 budget ($35/month). By contrast, Comcast met with us a few months ago, informed us that they had no intention of honoring the current contract and would strenuously oppose our efforts to have the contract assigned to us, and then offered the OA a new contract at nearly double that rate -- so being able to assume the current contract represents a great savings for SunCrest residents. Unlike some of our past dealings with Comcast, this morning's legal proceeding was amicable and agreeable, with no objections being offered to any of the proceedings. Tod Bean was present, to testify that the OA could indeed meet any financial obligations to Comcast. Barbara Blackmer was in attendance representing the homeowners, also Scott Blackmer was present as an observer. A representative of Zions indicated that Zions itself would be taking no position on the issue.
Yesterday, we met with the Trustee for the bankruptcy estate and representatives from Comcast in what was essentially an auction for the current contract. We had initially offered $10,000 to the estate, which was immediately countered by Comcast with an offer of $15,000. However, we offered $16,000 yesterday. Comcast then conceded, informed the Trustee that they would no longer oppose the assignment of the contract to the OA, and volunteered that they would continue to honor the contract. While this $16,000 may seem a substantial sum to offer in an auction, compare it to the original contract we were offered by Comcast, which would have cost us at least an additional $26,700 per month going forward indefinitely (if we had accepted their initial offer and not pursued our legal right to assume the contract). Our offer today does include payment for any unpaid past services provided by Comcast, as long as they can substantially verify this in a detailed statement. As the OA has carefully preserved all funds collected for that purpose, we can readily pay our bills, and pay the Trustee the auction amount. Even though the work of pursuing this contract took many months, there will be no special assessment to residents required in connection with this negotiation and litigation.
Under the terms of the contract, SunCrest OA is guaranteed “most-favored customer” status, a cap on annual rate increases, and essentially unlimited renewability. Residents remain free to purchase additional services from Comcast, of course, or to purchase alternative services from other providers. Doing so has no impact on your monthly dues to the OA.
After comparing this extremely favorable rate with other alternatives for high-speed internet and basic cable, we feel confident that we got the best possible deal for SunCrest residents. Tod Bean is to be commended for his hard work and perseverance in pursuing this contract; despite Comcast's initial reluctance to deal with us, discouragements and setbacks, we held to the vision that this contract should and could be assigned to the OA and provide long-term benefits to all owners within SunCrest. This morning, a federal judge agreed with us and so ordered.
Another feature of the contract for which we fought long and hard is the ability to suspend service to those residents who do not pay their OA assessments. This corrects the problem that those of us who pay our fees have been forced to subsidize TV and internet for the minority who do not. Importantly, we also got Comcast and the court to agree to a proviso in the court order specifying that residents cannot be charged more for service than Comcast is actually charging per household. As many of you know, in the past SunCrest LLC charged us roughly 40% more than it was actually paying Comcast. This proviso should protect us from any such conduct by a new developer.
Lastly, today's proceedings included the release of all claims from the bankruptcy estate, the now-defunct SunCrest LLC, Comcast, and the SunCrest OA. SunCrest LLC had entered a claim against SunCrest OA for a larger amount than that actually owed to Comcast (the 40% increase), and that claim is now formally released. We are no longer liable or potentially liable for any actions or amounts involved in the bankruptcy.
In a world of almost constant bad news and bleak financial outlook, I see this as a bright spot. Receiving high-speed internet and basic cable for less than half of what most folks pay can only add to the value of each home and the overall value of this community.

Covenants Committee Member Needed for SunCrest OA

SunCrest Owners Association is searching for a resident that desires to become a member of the Covenants Committee. This committee is a compilation of peers and is designed to address any grievances (fines, violations, landscape issues, fencing issues, etc.) from fellow members. While the Board makes the final ruling, it should be recognized that issues being heard by other members lends credibility to any decision that may come before the Declarant Board. The Covenants Committee meets every 1st Thursday of each month at 3:30 pm at the Information Center.

OA Meeting Minutes March 17

Homeowners in attendance: Barbara Blackmer (as trustee), Amy Baird (both contributed to the minutes-thank you!)

-The Board approved the meeting minutes of Dec.15 and introduced two new Board members: Ralph Matson who works for Zions Bank, and Mark Holliday, an attorney who frequently works with Zions Bank. Also in attendance was Richard Doxey, a Vice President at Zions and a Corporate Resource Officer.

-The OA is seeing good progress in collecting from delinquent homeowners, and bringing others into compliance. From almost 500 notices of delinquency to homeowners, we have 73 homeowners who are so delinquent that they will be going to lien as we've run out of options. Some of these are individuals who have never responded to letters of notice or demand, others actually worked out a payment plan and then defaulted on it and have not contacted the OA since. We do have other delinquent homeowners, unfortunately, and their accounts are being tracked and the collections process initiated (but not yet to lien). Homeowners who find it difficult to keep current should contact the management team and work out a payment plan. A copy of the "Assessment Collection and Enforcement Policy" is available to any interested homeowners who contact the OA offices, and should be available online before too long. Board members from Zions Bank were particularly insistent that there be continuing efforts to collect delinquent amounts.

-Board is considering proposals from law firms for more responsive and less costly assistance with liens and collections. Proposals will be examined to ensure that we have an agreement with reasonable fees and clear terms.

-City placed wood fences to block access in phase two of Deer Ridge in response to reports of vandalism and dumping.

-Vandalism on bathroom door in the Village Green may require replacing entire frame, door, and lock *PARENTS-PLEASE SUPEVISE YOUR CHILDREN WHILE WAITING FOR THE BUS.*

-We now have more SunCrest clubs for residents including a Breakfast Club -Management would like to update OA website and make it more user-friendly; several options have been compared and one selected

-Management would like approval to write off some old accounts. In some cases, homes had been sold 2 or 3 times and bills were being sent to the original owners. In other cases, the house has foreclosed. The Board will study this further before making a determination.

-Management would like to invest reserves in interest-bearing account. Richard Doxey was introduced to the Board and the management team, and offered his services to help us plan the best investment strategy for the Reserve Account.

-Comcast Deal: Nothing accomplished with negotiations yet. Final hearing in April should resolve the situation, with final assignment or denial of the contract

-At the direction of the Board, Tod Bean will investigate the possibility of draining the water feature at the Village Green, protecting the pumping system, and xeriscaping to make it look like a dry stream bed. This would cut maintenance costs significantly and present less of a hazard, particularly to children.

-Best for last: APPROVED for OA to purchase an inflatable outdoor TV screen and sound system for our community events. Even though we trimmed the budget considerably, we were able to keep this item in and we did a lot of comparison shopping to be sure we got the best price and that purchasing the screen will save money compared to renting as we have done in the past. More free movies in the park, with the possibility of rental availability to residents for private parties to be held at the Village Green.

Alpine District Students-Important!

The Alpine School District has sent "Out of Area Transfer Student" letters to some students in SunCrest based on instructions from a letter to the district dated 2006. The district employee who sent them out was confused by the boundaries and sent them to UT County SunCrest residents as well as SL County SunCrest residents because she didn't realize that UT County students have always been a part of ASD and are NOT transfer students. She also was not aware of HB 349, which was passed in January 2007, and grants ASD resident status to SL County students if they choose to attend ASD.

SR.org contacted the district today to clarify the sections of the Utah State Code that affect our area, and will be working with ASD, The Canyons/Jordan District, and the Utah State Office of Education to ensure that correct protocol is followed in the future.

For now, if you live in UT County SunCrest, since you are and always have been part of ASD, it is redundant to sign and send in a letter requesting out of area permission to attend ASD. Hold on to them until we can get this straightened out and can provide more accurate and updated paperwork that will satisfy USOE requirements and won't conflict with Utah State Code.

SR.org Meeting Minutes

Notes from SunCrestResidents.org meeting on Tuesday, February 10, 2009, compiled by Denise Borst, Voting Member and Neighborhood Rep.

Draper City has new code regarding blowing snow into the street. It can be found at the Draper City website, under Municipal Code, Section 7-13-030-Real Property to be Kept Clean and Secured. www.draper.ut.us.

Section (f) of that code reads: It is unlawful to place or deposit snow, ice or other material upon any City road or highway in such a manner as to interfere with the proper use of the same or in such a way as to obstruct travel or to endanger property or persons upon same.

Section (g) of the code addresses the responsibility of keeping a three-foot clear space around the circumference of fire hydrants, including the removal of trees, shrubs, trash and snow.

It is also the responsibility of homeowners to keep the area around mailboxes cleared of snow. The post office will not deliver mail if they cannot access the box.

Please be mindful that Mondays are our trash days and with all the trash and recycle bins out for collection, it is important to avoid parking in the streets.

Tod Bean updated the status of the efforts to collect past due assessments. 82 resident’s accounts have been sent for collection. Originally, close to 500 late notices were sent out, followed by a second notice to approximately 300 residents. 190 demand lien letters were then sent. So, as you can see, Tod and his staff are getting results with their diligent efforts to collect these past due funds.

The fire station is about 2 months from completion. There were some construction setbacks. The good news is that they have purchased an engine and ambulance for the new station and are in the process of selecting the crews.

DeLaina Tonks reported that she had an up close look at the new snowblower/auger that was purchased with the TRSSD funds for the sole use of the developments that pay the added TRSSD property tax.

No new developer has entered into discussion with Zion’s Bank to purchase and develop the SunCrest property.

Watch for information on the Annual OA Meeting to be held in June.

The next quarterly OA board meeting will be held on Tuesday, March 17, 2009 at 3 p.m. in the SunCrest Information Center.

Four Year-Round Elementaries Moving To Traditional Schedules Next School Year
The Board of Education in Study Session directed the administration to move four year-round schools -- Crescent,Lone Peak, Oak Hollow and Willow Springs Elementaries -- to traditional calendars for the 2009-2010 school year. The board also hopes to move Sprucewood Elementary to a traditional calendar pending the results of an upcoming community facilities and enrollment task force. The Board’s action stems from enrollment data and an extensive study the Jordan Board of Education, of which four Canyons Board members are part, conducted about a year ago. Board members said the majority of parents in year-round schools have long supported a change to a traditional school year.

New Hires Announced
The Board approved hiring one principal and eight district administrators. They are:
Draper Elementary School Principal: Kenna Sorensen, assistant principal at Fort Herriman Middle School and former elementary school teacher; Director of Accounting & Budget: Leon Wilcox, Senior Accountant for Granite School District; Director of Nutrition Services: Sebasthian Varas, a Jordan District Registered Dietitian with a Master’s Degree in Business Administration; Director of Transportation: Kenneth Spurlock, Hillcrest High School Assistant Principal who has worked with the Utah Transit Authority and the Spokane Transit Authority; Director of Purchasing: Gary O. Hansen, Purchasing Director and Chief Procurement Officer for Granite School District; Director of Facilities (including Maintenance): Rick Conger, a Davis
School District Special Projects Coordinator and former Jordan District Director of Maintenance Services; Director of Technology Services: Darren Draper, Jordan District Technology Curriculum Specialist; Director of Technology Deployment: Dave Heywood, a Technical Service Supervisor for the company Edustructures and former Jordan District Computer Repair Technician; and Technology Consultant: Michael Wilkinson, a Project Team Lead, Senior Systems Administrator and Network Engineer for Spillman Technologies.

Boundaries, Busing Approved for Northeastern Cottonwood Heights The Board approved placing former Granite District residents within Bella Vista Elementary boundaries and offer busing for one year.

Student Recognition The Board honored the Hillcrest High School Drill Team, which swept the state championship, and Alta High AP History students who attended the Inauguration of President Barack Obama. Board, Superintendent Reports Superintendent David Doty reported on meetings with state and local elected officials. Board member Ellen Wallace reported on the Utah School Boards Association’s day on Capitol Hill, concerns about child nutrition and fitness detailed in a newspaper article, and schools honored in the news. Kevin Cromar reported on the USBA’s legislative day and suggested including honors programs along with gifted education in middle schools. Paul McCarty hopes to schedule a Digital Bridge board presentation March 3. Kim Horiuchi noted open houses scheduled at Butler Middle School Wednesday and at Bella Vista Elementary Feb. 18. Mont Millerberg praised new district hires.

Study Session
The Board received an update on legislative activity, and discussed how to select members of the enrollment and facilities task force; whether to change board meetings to Wednesday evenings so board members can attend Tuesday city- and school community council meetings; and whether to hire a project manager to help the
district ramp up for services.

Bill Rappleye Russ is in charge of this project but I did not have a sense there is a rush, bring the comments to the next council meeting (public comment at the first of the mtg)or we could work to have it as an agenda item at a future mtg.

Layne sent me the pictures of the proposed styles.

The top one is the Water Tower and the bottom is the called the Stealth Monopine. The location is just south of the market/The Cove.
