We have been receiving a lot of phone calls from residents wondering if they still have to pay their OA fees since the developer has gone bankrupt.
The answer is "yes". SunCrest LLC is the corporation that the national company Terrabrook established to manage the SunCrest project. SunCrest LLC has filed bankruptcy. However, the Owner's Association and the management company, CCMC are still fully functioning. They are the ones who collect the OA dues, arrange for lawn maintenance, snow removal, etc, and they are still here. The penalties for not paying your dues range from receiving a notice to putting a lien on your property, so keep sending in those dues.
There should be very little change in the day to day operations of SunCrest, and as residents, we are going to be impacted very little by the bankruptcy. SunCrest LLC was obligated to send notice to the residents, but that's pretty much all it is.

When will we start to see the sidewalks cleaned and general maintenance being done? I thought it looked the way it did b/c of the bankruptcy, but now I read where the OA and CCMC is still functioning. It would be nice if Suncrest could look a bit more presentable.

Is there a specific area to which you are referring? Some areas are still the responsibility of the builders, like where I live, and they have been out cleaning them up a bit, but I agree that we should work together to help SunCrest look its best.
These dues are a total waste. In theory we are paying for a service; the problem is nobody knows exactly what that service is. Mostly I feel like the money I send in goes into some deep black hole never to be seen again. SunCrest used to be nice and clean now it is a total mess everywhere you look.
Yes...in theory and on paper CCMC is still funtioning but I question their legal authhority.
I would like to see a change in HOA management.
They have come up with a huge budget not having to answer to the homeowners and we are just suppose to sit back and accept it.
How do you like the high-gloss news letter? I wonder how much that cost? I was fine with the 8 1/2 x 11 photocopied information. The inforamtion did not change because fancy newsletter
How did you like receiving your 4 payment coupons the last part of 2007. A huge oversize mailer that contained 4 payment coupons. The postage along was around $2-$3 each as I recall.

Anonymous-if there are specific areas of messiness that are of concern to you, please let us know and we can work together to take care of it. Some areas are the OA responsibility, others are not, so if you can list specific places, we can establish responsibility and make sure that the appropriate people are working on them.
Mark-It is very important that we know where the legal authority lies in a situation like this, so we'll send this on to Scott Blackmer and Paul Tonks, and hopefully they will be able to clarify and answer your concerns.

As you mentioned, it would be nice to know what areas they are inquiring about. As for the OA property (Village Green, Monument Signs, Islands, etc) the spring clean-up will begin next week.
However, I did notice a crew up here last week in front of The Cove and on Traverse Ridge Rd cleaning the sidewalks and picking up the trash.
Also, there are sidewalks/slopes that the City of Draper must maintain.
We are in the process of developing a master map showing what the Developer, OA and the City owns. When this is complete, would you like a copy?

We have noticed a lot of trash on the slopes surrounding, and across the street from the church heading into Oak Vista. Who is responsible for these areas?

According to the Salt Lake County Assessor, the areas you’re a referring to is owned and maintained by the City of Draper. I will be calling the City to inquire if they have a clean-up scheduled for their areas of responsibility.

I agree about the trash surrounding Suncrests open areas. I am a resident of Southfield and we have trash right across the street from us on the surrounding hills and behind us in the micron? Draper? area (I am really unsure who the land belongs to?). From the looks of it, it does mostly seem be from the construction workers who have left their stuff behind or allowed large tarps and boards be blown away! It sickens me to see all the trash that has appeared over night. I believe this is a BIG concern!
